1. No use shall be made of the Common Areas and Facilities except as permitted by the Trustees of DEER CROSSING CONDOMINIUM TRUST.
2. There shall be no obstruction of the Common Areas and Facilities, nor shall anything be stored in the Common Areas and Facilities. The Trustees may make repairs and perform maintenance as may be necessary, their discretion required, the cost of which shall be assessed against the offending unit owner. The owner shall be given reasonable notice except in case of emergency.
3. Nothing shall be done or kept in the Common Areas and Facilities which will increase the rate of insurance of the Condominium or contents thereof, applicable for residential use. No Unit Owner/Tenant shall permit anything to be done, or kept in the Common Areas and Facilities, which will result in the cancellation of insurance of the Condominium, or contents thereof, or which would be in violation of any law.
4. Unit Owners/Tenants shall not cause or permit anything to be placed on the outside walls of a unit or building and no sign, shutter or radio/television antenna shall be affixed to or placed upon the exterior walls or roofs, or any part thereof. "For Sale", "For Rent", "For Lease" signs or other displays or advertising shall not be maintained or permitted in any part of the Condominium or in any unit therein.
5. Unit Owner/Tenants will not be allowed to put their names on any building or Common Areas and Facilities.
6. No offensive activity shall be carried on in the Common Area and Facilities, nor shall anything be done therein, either willfully or negligently, which may be or become an annoyance or nuisance to the Unit Owners/Tenants or occupants. No Unit Owner/Tenant shall make or permit any disturbing noises by him/herself, his/her family, servants, employees, agents, visitors, Lessees, and licensees, nor do or permit anything by such persons or convenience of other Unit Owners/Tenants.
7. Nothing shall be done in, on, or to the Common Areas and Facilities which will impair the structural integrity of the buildings or which would structurally change the buildings without the approval of the Board of Trustees.
8. No clothes, clotheslines, sheets, blankets, laundry or any other articles shall be hung out of a unit or exposed on any part of the Common Areas and Facilities. The Common Areas and Facilities shall be kept free and clear of all rubbish, debris, and other unsightly materials. Nothing shall be altered or constructed in or removed from
the Common Areas and Facilities. Except for rear-window air conditioning units, nothing shall be hung from the windows or placed upon the "outside windows" or sills. Rugs or mops shall not be shaken or hung from or on any of the windows, doors, or decks. Garbage and trash shall not be placed outside of any unit.
9. DERELICT VEHICLES ARE PROHIBITED. For the purposes of this Rule, a derelict vehicle is defined as a motor vehicle which
exhibits no license plate, is leaking oil or other fluids on the common property, does not display a current inspection sticker, is inoperable or is uninsured. No derelict vehicle as above defined shall be permitted on the common property of this Condominium. Any derelict vehicle which is parked on the common property shall be towed from the property by the Association at the owner's expense after reasonable written notice to said owner or tenant.
10.There shall be no parking of motor vehicles, baby carriages or playpens, bicycles, wagons, toys, benches or chairs, on any part of the Common Areas and Facilities except that roads, parking areas and driveways may be used for their normal and intended purposes. There shall be no organized sports activities, picnics or fires except in areas approved by the Trustees.
11. Washing of vehicles is allowed provided that all residue and cleaning equipment (cleaning solvents, rags, hoses, buckets, etc.) are removed. The pavement shall be cleaned of all suds or other cleaning fluids. No repairing or maintenance of automobiles (including oil changes) shall take place on any part of the property, nor shall the Condominium Parking Areas be used for any purpose other than to park motor vehicles excluding open bodied trucks exceeding 3/4 ton, motorcycles, motor bikes, RV's* and vehicles displaying lettering, trade tools or rubbish. Not withstanding the foregoing, in cases of emergency, commercial vehicles may be parked within the Condominium Parking Areas. No Unit Owner/Tenant shall park more than two (2) motor vehicles on a continual basis within the Condominium Parking Areas. *Temporary parking up to 24 hours is permitted for owners of RV's for the purpose of loading and unloading.
12. If any key or keys are entrusted by a Unit Owner/Tenant or occupant or by any member of his/her family, or by his/her agent, servant, employee, licensee, Lessee or visitor to an employee of the Trustees, whether for such unit or an automobile, truck or other item of personal property, the acceptance of the key shall be at the sole risk of such Unit Owner/Tenant or occupant, and the Trustees shall not be liable for injury, loss or damage of any nature whatsoever directly or indirectly resulting therefrom or connected therewith.
13. Each Unit Owner/Tenant assumes responsibility for his/her own safety and that of his/her family, guests, agents, servants, employees, licensees and Lessees.
14. Unit Owner/Tenants will be held responsible for the actions of their children and their guests.
15. A Unit Owner/Tenant may invite a maximum of four guests to use the Condominium Clubhouse Facilities and swimming pool at anyone time. However, a maximum of 6 persons per unit is allowed at any given time. Additional posted rules at all facilities must be followed.
16. The method of handling complaints of any kind is as follows: The Complaint should be made in writing to the Property Manager. If the Owner(s) does not receive a satisfactory response from the Manager within 30 days, the complaint should be forwarded to the Trustees in writing. The complainant shall be notified in writing within 15 days of the next Trustees' meeting, at which time all interested parties will be invited to address issues set forth in the complaint. After which the Trustees shall take appropriate action as provided by the law and Condominium documents and shall notify the interested parties thereof, in writing, shortly thereafter.
17. No pets of any kind shall be kept or permitted in any unit without the consent of the Board of Trustees. Pets are to be restrained at all times and their waste removed immediately. Their leash should be hand held, in control and not exceed 6 feet. Whereas there has been some confusion about pet ownership in the past, the Board of Trustees has determined that those who presently have pets may retain them but may not replace them without the Board's consent.
18. If an Owner/Tenant is notified of a violation it must be corrected within the time specified. After a hearing on the matter, at which interested parties will be given an opportunity to be heard, if the Board finds such a violation exists, a fine of $20/per day will be levied until the offense is corrected.
19. The Deer Crossing Clubhouse is a "No Smoking" building.
20. These Rules & Regulations may be amended from time to time as provided in Article V, Section 5.6 of the Trust By-Laws
